Judgement of Restoration’s Dismissed Application of Injunction

Choicism.com has sighted the judgment that was given by Mrs. Olivia Obeng Owusu, Justice of the Cape Coast High Court who dismissed the application brought before her by Opoku Nti Ernest (Restoration) who filed an application against the Dean of Students, UCC and four others.

But it should be noted that his counsel, has filed an appeal which is likely to be heard on Tuesday,March, 8, 2014.

Below is the summary of the judgement but the full judgement is still with the court.

I am unable to find that serious questions have been raised to warrant the exercise of my discretion in favour of the applicant. Taking the balance of convenience into account I think there is much to be said against the grant of the application. The applicant filed the motion on the 19th day of March, 2014 just two weeks before the scheduled elections. It is my considered opinion that the balance of inconvenience weighs heavily in favour of the Respondents. I am unable to find that a case for the grant of injunction has been made.

In the circumstances, the motion must fail and I dismiss it.
